Terms and Conditions for WordPress Website Design Packages
Introduction
Welcome to MadCom Digital. By purchasing and using our WordPress Website Design Packages, you agree to the following terms and conditions. Please read them carefully before proceeding with our services.
Services Provided
- Design Services: MadCom Digital offers custom WordPress website design services as outlined in your selected package. Services may include but are not limited to custom design, responsive layout, SEO optimization, e-commerce setup, and basic training.
- Scope of Work: The specific scope of work will be detailed in a project proposal or contract provided before the start of the project. Any additional services or changes requested outside the agreed scope may incur additional charges.
Payment and Billing
- Payment Terms: A deposit of 50% of the total project cost is required to commence work for once-off packages. The remaining balance is due upon project completion and before the website goes live.
- Late Payments: Failure to make timely payments may result in project delays or suspension of services until the account is brought current.
- Refunds: Due to the nature of our services, refunds are not provided once work has commenced. If a project is canceled before completion, the client is responsible for payment of services rendered up to the point of cancellation.
Client Responsibilities
- Content Provision: The client is responsible for providing all necessary content, including text, images, and other media, unless otherwise agreed. Delays in content provision may impact the project timeline.
- Access and Information: The client must provide all necessary access and information required for the design and development of the website, including admin access to existing websites and relevant third-party services.
- Approval and Feedback: The client agrees to provide timely feedback and approvals during the design process. Delays in feedback may impact the project timeline.
Revisions and Changes
- Revisions: Our design packages include a specified number of revision rounds. Additional revisions beyond the agreed number may incur additional charges.
- Change Requests: Any significant changes to the project scope after the initial agreement will be subject to additional costs and may affect the project timeline.
Project Timeline
- Estimated Timeline: The project timeline provided is an estimate based on the agreed scope of work. We will make every effort to meet the timeline but are not liable for delays caused by the client or unforeseen circumstances.
- Launch Date: The website will be launched upon final approval and receipt of final payment. Any delays in payment or approval from the client may delay the launch.
Ownership and Rights
- Design Ownership: Upon full payment, the client will own the final website design. MadCom Digital retains the right to use design elements and the completed project for portfolio and marketing purposes.
- Third-Party Services: Any third-party services, including stock images, plugins, and software, used in the project are subject to their respective licenses and terms of use.
Liability
- Limitation of Liability: MadCom Digital is not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use our services or the completed website.
- Indemnification: The client agrees to indemnify and hold MadCom Digital harmless from any claims, damages, or expenses arising from their use of our services.
Termination and Suspension
- Termination by Client: The client may cancel the project at any time by providing written notice. The client is responsible for payment of services rendered up to the point of cancellation.
- Termination by MadCom Digital: We reserve the right to terminate or suspend services immediately if the client breaches these terms and conditions or if their actions compromise the security or integrity of our services.
Changes to Terms
- Modification: MadCom Digital reserves the right to modify these terms and conditions at any time. Clients will be notified of any significant changes, and continued use of our services constitutes acceptance of the revised terms.
Governing Law
- Jurisdiction: These terms and conditions are governed by and construed in accordance with the laws of South Africa Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in South Africa.
